History of the National Land and Housing Organization
According to Resolution No. 35 / D Sh dated 15/6/1372 (06 September 1993) of the Supreme Administrative Council, which caused changes in the duties of the Urban Land Organization, the name of this organization changed to National Land and Housing Organization and its Articles of Association was amended in 1375 (1996). According to the amendment, the National Land and Housing Organization is a stock company with an indefinite term, affiliated with the Ministry of Housing and Urban Development, which has legal personality and financial independence; and is governed according to the Commercial Code, articles of association and regulations governing state-owned companies. Among the goals of this Organization we can mention, carrying out the Urban Lands Law, setting housing policies and laying the groundwork for plan implementation through modeling, investing independently or with the participation of the public and private sectors, obtaining loans, and participating in the development of construction materials factories.
After the merger of the two Ministries of Roads and Transportation, and Housing and Urban Development in 1390 (2011), this Organization operates as one of the subdivisions of the Ministry of Roads and Urban Development.
The National Land and Housing Organization is a state-owned company affiliated with the Ministry of Roads and Urban Development. It has an independent legal entity and is governed as a private limited company for an indefinite period. The Organization enjoys financial independence. The Organization’s capital is eight hundred and twenty-nine billion and fifty-eight million seven hundred and seven thousand five hundred and fifty-nine (IRR 829,058,707,559/-) Rials divided into eighty-two million nine hundred and five thousand eight hundred and seventy (82,905,870) share of IRR 10,000/- that has been fully paid and 100 percent (100%) belongs to the Government.
The purpose of the establishment of the Organization is to plan and organize the activities the responsibility of the Ministry of Roads and Urban Development in the following areas:
A- Supply, management, and exploitation of land
B- Activities in the field of providing housing within the framework of Comprehensive Housing Plan and notified policies of the Government and the Ministry of Roads and Urban Development; (Pursuing Mehr housing projects implementation in the cities with more than 25,000 population across the country)
The Organization’s activities are as follows:
1- Performing the affairs and duties mentioned in the relevant laws and regulations regarding land and housing within the limits and bounds of cities and towns in order to protect the rights, agency, and ownership of the Government regarding the unclaimed, state, national and range lands, limits and freshly-constructed and coastal lands, assigned lands, plantations, and real estates and constructed premises in private lands, townships and abated incomplete complexes, and other lands and properties whose performance of the affairs within the limits and boundaries of cities and townships were entrusted to the Housing Organization, the Urban Land Organization and the National Land and Housing Organization
Other executive duties have been and will be performed by the Ministry of Housing and Urban Development in accordance with the laws and regulations, within the framework of Government policies and relevant laws and regulations.
2- Offering the necessary suggestions in the field of strategies, policies, medium- and short-term plans, rules, regulations and necessary instructions related to the objectives and issues of the Organization's activities and duties to the Ministry of Housing and Urban Development in order to complete the approval steps with the competent authorities
3- Carrying out housing support programs for low-income groups, establishment of residential complexes and townships, investment and participation in providing housing within the limits of cities and towns based on policies announced by the Ministry of Housing and Urban Development in accordance with relevant laws and regulations
4- Designing in the fields of urban design, residential units and urban details design and construction through the implementation of special plans and projects, with coordination of specialized areas within the Ministry of Housing and Urban Development
5- Assignment of lands, properties and newly-constructed real estate under ownership as in lieu of a consideration or in compensation for the claims of individuals from the Organization through compromise, barter, exchange, sale and lease of lands, real estate, freshly-constructed properties owned by observing the relevant regulations, urban planning rules and civil development plans
6- Possession and takeover, agreed purchase, lease, barter, exchange of lands and properties in compliance with the relevant laws and regulations
7- Exercising the rights of ownership toward government lands and properties at the disposal on behalf of the Government (Ministry of Housing and Urban Development) such as identification, retention and supervision, mapping, aggregation, apportion and separation thereof, and pursuit and defense of relevant lawsuits based on the announced policies of the Ministry of Housing and Urban Development by observing the relevant laws and regulations
8- Drawing, conducting, and mobilizing public and non-governmental resources, as well as receiving government assistance through partnership with natural persons and legal entities, supporting the formation of public joint stock companies and the like, issuing government bonds, obtaining loans from credit and monetary institutions and the banking system in compliance with relevant laws and regulations
9- Planning and creating a ground for utilizing the financial resources and services of foreign institutions and companies for the State housing professions and, if necessary, concluding contracts in order to utilize their financial resources and services for the Organization by observing the relevant laws and regulations
10- Providing technical, engineering, and knowledge services, using new technologies in the production of materials, construction and manufacturing parts in the implementation and operation of the country's housing supply programs and projects
11- Formulation of the issues related to housing factories assignment to the private or non-governmental sector by applying incentive and supportive programs and policies in compliance with the relevant laws and regulations
12- Supporting, encouraging, persuading, and directing private, cooperative and non-governmental public sectors to establish, create and renovate housing factories or construction materials and parts, as well as modifying or changing the manufacturing line of factories for the purpose of increasing the speed, quality and industrial housing
13. Design, construction, purchase, lease, repair and maintenance, demolition and renovation, lease and management of organizational houses within the limits of the relevant laws and regulations and the credits that are provided to the Organization for this purpose
14- Supporting the activities of private, cooperative and non-governmental public sectors in providing housing for low-income and needful groups, downsizing, mass-developing through land assignment, creating facilities, discounts on providing technical assistance based on the policies announced by the Ministry of Housing and Urban Development
15- Supporting researches, scientific activities, human resource development, and other effective factors in improving the management of the affairs related to the objectives of the Organization
16- Collecting information, creating information systems related to the needs of the Organization and designing databases in the fields of land and housing, construction methods, parts and building materials and other tasks of the Organization
17- Carrying out applied studies relevant to the Organization’s duties
18- Coordination with the relevant authorities and agencies regarding the preparation of executive plans for land and housing and urban planning and architecture affairs
